Terms of Service

1. Acceptance of Terms

By accessing or using the Next Level Irrigation (“NLI”) platform, including the web dashboard, customer portal, mobile applications, and API, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Description of Service

NLI provides a cloud-based irrigation management platform that enables commercial landscapers to monitor controllers, manage watering schedules, track water usage, communicate with customers, and integrate with smart home ecosystems. The platform includes a technician dashboard, customer portal, REST API, and mobile applications.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. NLI reserves the right to suspend or terminate accounts that violate these terms.

Administrators who create accounts for team members or customers are responsible for ensuring those users comply with these terms.

4. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the platform
  • Interfere with or disrupt the platform or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Use the API in a manner that exceeds reasonable request limits
  • Share API keys or account credentials with unauthorized parties
  • Use the platform to send spam or unsolicited communications

5. Intellectual Property

The NLI platform, including its design, code, branding, and documentation, is the property of Next Level Irrigation and is protected by intellectual property laws. Your use of the platform does not grant you any ownership rights.

You retain ownership of all data you upload to the platform, including controller configurations, customer information, and telemetry data.

6. Limitation of Liability

NLI is provided “as is” without warranties of any kind. To the maximum extent permitted by law, NLI shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, property damage from irrigation malfunction, or business interruption.

NLI is not responsible for the operation of third-party irrigation controllers, sensors, or connected hardware. Users are responsible for verifying that irrigation schedules and controller configurations are appropriate for their specific installations.

7. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the platform will be revoked. You may request export of your data within 30 days of termination. After 30 days, your data may be permanently deleted.

8. Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Miami-Dade County, Florida.

9. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via the dashboard or email at least 30 days before taking effect. Continued use of the platform after changes constitutes acceptance.
